Drugs Against, Punjab High Court strictly orders from DGP and SSP
The Punjab and Haryana High Court has taken a strong stand against the apparent lack of progress and failure to arrest the accused in drug-related cases, particularly under the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The court asked the Director General of Police (DGP) Punjab to issue immediate instructions to all Senior Superintendents of Police (SSPs) across the state to actively monitor the progress of investigations in these cases.
Justice N.S. Shekhawat, presiding over the matter, emphasized the urgent need to address the issue, as a large number of accused—a total of 97—have been arrested in 83 criminal cases in Bathinda district alone, despite the passage of more than six months. Giving stern directions, Justice Shekhawat ordered that any accused not apprehended within a reasonable time should be declared a fugitive (PO) without delay, and their properties should be attached as per law. are The move is aimed at ensuring that the justice system is not undermined by police delay and incompetence?
Further, the Punjab DGP has been directed to submit an affidavit detailing all cases under the NDPS Act across the state, where the accused have been absconding for more than six months. The affidavit should also mention whether efforts have been made to declare these persons as absconders and initiate the process of attachment of their properties.
The court’s orders came in response to an anticipatory bail plea filed by an accused, who was not arrested for 11 months. During the hearing, Justice Shekhawat had earlier directed the Bathinda SSP to submit a comprehensive report on all NDPS Act cases in the district where arrests were not made within the stipulated time.
It was revealed in the court investigation that the Bathinda police officers arrested the accused and sent them to P.O. have failed to perform their legal duties including initiating proceedings. The affidavit given by the Bathinda SSP reveals that there is a lack of proper supervision by the higher police officers and no concrete efforts were made by the investigating officers to arrest the accused.
The court added that despite the gravity of the situation, a departmental inquiry was initiated only against the erring officers, and later these officers were transferred to other police stations. Justice Shekhawat made it clear that such negligence could not be tolerated and ordered immediate attachment of the properties of the accused as per legal provisions.
The High Court’s intervention underscores the importance of timely and effective law enforcement, particularly in cases involving serious offenses under the NDPS Act. The directives issued are aimed at holding police officers accountable and ensuring that justice is served without delay.
